What does it mean that a person's trial will not have the same elements if they have a mental illness? Mental illness opens doors to the complexities of the human brain and how it works; without properly understanding the brain, it is not possible to understand the disease. It is not something anyone can control and without diagnosis and treatment people will not get better. Forgetting Furman) and a 5 year old would never face the death penalty for crimes of emotional inadequacy. Those suffering from mental illness should be treated and rehabilitated, not put to death
