In the criminal justice system, the best chance for a fair trial and justice lies in cases that include physical evidence. Physical evidence, whether fibers, fingerprints, or DNA, can provide the jury with proof beyond a reasonable doubt. Physical evidence can convict a criminal or free an innocent man. It can bring closure to the families and law enforcement dealing with the cases. The following cases will show the effect of physical evidence in a criminal trial and the vast impact it can have. For each case I will look at how the physical evidence was important to the case and whether or not it could have made a bigger difference if the presentation of the evidence had been different. The five cases are: the Mosley case, the Warren case, the Chandler case, the Frediani case and the Swift case. First there is the Michael Mosley case. Michael Mosley was convicted of murder a couple of ten years ago (Wurtman, 2011). Two other men were cleared when Mosley's DNA was found at the murder scene (Crowe II, 2012). Additionally, there was a palm print on the wall and additional DNA on the bedroom sheets (Wurtman, 2011). In contrast to all the evidence, Mosley's attorney offered an alternative reason and painted a picture of several events to explain the presence of Mosley's DNA (Wurtman, 2011). However, the jury did not believe the defense version and the conviction of Michael Mosley led to a request to work on the DNA database and the most interesting fact is that Michael Mosley had no DNA in the system until seven years after the crime.
