It is important to keep in mind that the term constitutional state differs theoretically from constitutional democracy, as well as in practice. Any form of government together with the electorate can establish a constitution. The prime example of this is totalitarian communism and its formal progressive constitution. There are many other autocratic regimes around that meet these criteria. In simple terms, even if such a system applies the laws of the constitution and follows all prescribed rules with the support of the state apparatus and courts, it is only a rule of law or rechtsstaat. It is called dictatorship and not constitutional democracy or democratic state with the rule of law at the top. There is no denying that power can only be limited by another equal power. In other words, the main factor of internal stability and balance is the division of power and mutual control according to a law approved by the national constitution. Furthermore, it is necessary to pay attention to the fact that there have been no major wars in the last 60-70 years in Europe, which is certainly due to the deep entrenchment of constitutionalism after the Second World War. It would be correct to mention the preventive effect of constitutionalism in this context as well as a strong Constitutional Court.
