The Constitution and the accountability mechanisms of the Prosecutor's Office in South Africa. The Constitution of the Republic of South Africa, 1996, created a single National Prosecutor's Office called the NPA, which is controlled by the National Prosecutor's Office Act (Act No. 32 of 1998). Article 179(2) of the Constitution provides that the NPA has the power to initiate criminal proceedings on behalf of the State, to carry out all necessary functions related to the initiation of criminal proceedings and to interrupt criminal proceedings. Parliament passed the National Prosecution Act 1998 to give effect to the provision of s179 of the Constitution. This is evident in the National Director of Public Prosecutions case against Zuma. In this case the weight was given in the main interpretation of Article 179 of the Constitution. The SCA found that this section did not require that the NDPP should invite Mr. Zuma to state why he should not have been prosecuted before charging him, and to provide him with a full explanation of why it had previously been decided not to prosecute and not followed up..
